State of Georgia v. E.H. Cobb County State Court (Marietta, Georgia)

Our client was charged with driving under the influence of drugs (marijuana), possession of marijuana, and speeding. After being stopped by Officer Nolen of the Cobb County Police Department, who is a certified drug recognition expert, our client underwent any evaluation for horizontal gaze nystagmus and pupil size. Subsequent to performing these evaluations upon our client, the officer performed a search of our client's vehicle and discovered marijuana in his vehicle.

Based upon the field sobriety tests and the marijuana, our client was placed under arrest for driving under the influence of drugs (marijuana), possession of marijuana, and he was also charged with speeding.

After reviewing the video of the stop and consulting with a nationally recognized field sobriety expert, Tony Corroto, we successfully negotiated a DISMISSAL of our client's DUI charge and received a plea under the First Offender Act with regard to his marijuana charge. After he completes probation, our client will only have a SPEEDING conviction on his record.
